His appeal doesn’t stand much of a chance. His gamble was to try to delay it long enough to get a GOP President who would pardon him, but by all accounts they’re going to speed through the appeal in record time.

Early voting is looking not so great for Dems. Not as terrible as forecast but still not great. The challenge here though is the Dem strategy was to campaign for the more extreme GQPers during the primaries, with the logic they’d be easier to beat. So they may lose less than forecast, but end up filling those losses with batshit insane Congressmen. It was a risky gamble that I’m not sure is going to pay off long term.

The gamble was that the crazy ones enact undertow voting, where moderate Rs secretly vote D, but:
A) if it doesn’t pay off we’re left with proper crazy people in places where they can directly impact future elections
And
B) if it pays off it’ll just add fuel to the fire that elections are stolen, because early polls go off voter registration.
It was always going to be a tough midterm but this is quite a lose lose situation.

That one is a bit of a weird one. Temporary stays on these decisions prior to being evaluated by the full court are routine and almost always expected, so from a process and legal viewpoint it’s administrative business as usual - Clarence is responsible for claims coming from that circuit so he got it by default. It’s just an optics issue as arguably he could/should have recused himself from it and handed it over to a difference scotus justice. It’ll be a more broader issue if the full court decides to uphold the appeal, but for now it’s really just serving as a talking point.
