I'd struggle with it being an issue from 2016, because consumers had a choice to buy alternatives. But I can definitely see there being an argument for the price fixing affecting owners of the digital PS5.

Surely this only works if there’s evidence that a digital item has a higher RRP than a physical one, and I’m not sure that’s ever been the case. Some seller discounting under RRP isn’t really the same thing and I can’t see this going anywhere.

Yeah, I'm reading this and I can't see this gaining traction seeing as they'll just say they've been setting against the RRP and not the discounted prices that are offered by online retailers for boxed copies. If you go somewhere like a brick and mortar store like Game and GameStop you're going to pay RRP someone like Amazon will eat that cost to get people through the door. It isn't remotely the same.

I remember Guardians of the Galaxy being on a big discount over a month after release. The premise is that people are unable to wait for a discount. Is this just a law firm try to drum up publicity?

The only thing that makes me think that they have a claim here is that funders are involved (and Counsel has therefore advised them to proceed). They don't take a punt on anything below a 60-70% chance of success unless they want to go out of business.

They should be getting sued for being just straight up rip off bastards. £70 for a game! . Plus that standard bs UK thing we've always put up with where often Sony sell a game for the same £/$ no matter the exchange rate. £70 for a digital copy they can block at any time.

They control the market for digital sales. If I could buy digitally ANYWHERE else then fair enough, but I cannot.
It is a closed market, they have a monopoly.

That's the thing about both this, and the Epic vs Apple trial. It's not a monopoly if you have legitimate competition or alternatives.
People act like Sony makes the only console, Apple makes the only phone.

I'm not sure about Nintendo but with Microsoft you can buy the digital codes elsewhere. So the one new game I purchased on Xbox was £10 cheaper for the code at shopto. I had the choice of where I purchased my digital game.

If you have a digital only PS5, as I do, the only place you can purchase content is on the store.
Simple as that. You are be locked into one source with no competing market. So obviously a monopoly.
Xbox and especially Steam/PC you can shop around to your hearts content.
I don't for a minute think they will win the case BTW, the world we live in is currently is set up to fuck over the consumer more times than not.

An "easy" defense against people who have a digital console though is that you chose to purchase it and therefore chose to limit yourself to that storefront. To be fair that's only an "easy" defense because non digital versions are available. It's not something I think justifies the prices as they are too high but it's very easy to say "alternatives are available and this is what you chose".
They can also argue that gaming is a luxury not an essential and that no one is forcing you to buy on day one citing the various sales they have as proof that opportunity to get them at a lower cost exist. FOMO isn't their responsibility.
Again I don't agree with the pricing at all and think they are taking the piss but until digital truly is the only option it's not going to be a strong argument.
