It's basically a strawman at the moment. Even if it did happen the actual person who it happened to is not interested in persuing it, which in cases where it is based on personal accounts is a non starter case wise.
This is why the story has tried to pivot to messages being abusive, because now they're trying to use the court of public opinion rather than anything proper.
It's impr that they're doubling down, though.
